1. Definitions

1.1. “Insurer”: the party offering the Senifone S1 smartphone insurance.

1.2. “Insured”: the consumer who enters into the insurance contract for the Senifone S1.

1.3. “Policy”: the insurance contract (insurance) with all the conditions, rights and obligations contained therein.

1.4. “Subscription”: the method by which the premium is paid, namely: monthly, every 3 months or annually, whereby the agreement continues until timely cancellation.

1.5 “General terms and conditions'': The general terms and conditions relating to the insurance agreement.

2. Policy duration and Subscription types

2.1. The insurance is taken out for the Senifone S1 and is concluded in one of the following subscription forms:

- Monthly subscription
- 3-monthly subscription
- 1-year subscription

2.2. The insurance premium is automatically debited periodically.

2.3. The agreement continues until cancellation. Cancellation can be communicated by the Insured at any time in writing or via the designated digital channel.

2.4. After receipt of the cancellation, the insurance will remain valid until the end of the current subscription period and will not be automatically extended.

3. Insured Risks – Coverage

The insurance covers damage to the Senifone S1 in the following situations:

3.1. Theft/Burglary

- Theft or burglary with demonstrable evidence, where an official report has been made to the police.

3.2. Water damage

- Damage resulting from contact with water, provided that the damage occurred acutely and directly as a result of an incident.

3.3. Fall damage

- Damage caused by the device falling (fall damage), provided that the operation of the device is affected by the damage.

3.4. Mechanical failure/ Internal defects

- Damage or malfunctions resulting from mechanical problems or internal defects, which are not the result of external abuse.

3.5. Battery defect

- Damage to or defects of the battery, if these manifest themselves outside the warranty period.
- A tired battery (one that has deteriorated in capacity and/or power over time and use) is not covered by the insurance provided.

3.6. Fire damage

- Damage to the device as a result of fire, where this is a direct consequence of an external fire incident.

3.7. Defects after the warranty

- Technical or functional defects that occur after the manufacturer's warranty has expired, unless these are the result of the user's own fault or careless use.

4. Exclusions – Not Covered

The insurance does not provide cover for:

4.1. Damage due to cosmetic defects, such as scratches, dents or small cracks, provided that the device is still functioning properly.

4.2. Loss of the device, regardless of the circumstances or circumstances.

4.3. Damage to the device that is the direct result of the Insured's own faults or negligence, for example:

- Intentionally or accidentally damaging the charging port.
- Intentionally or accidentally damaging the headphone port
- Intentionally damaging, removing or scratching the camera glass (camera glass will only be replaced if the camera's operation is affected by the damage)

4.4. Damage resulting from careless or irresponsible use, including:

- Intentional neglect of the device, causing the charging port, speaker or other parts to become in such a condition due to the accumulation of dirt and/or other substances that operation is impeded.

4.5. Damage caused by failure to follow the operating or maintenance instructions as stated by the manufacturer of the Senifone S1

5. Damage Handling and Claims Conditions

5.1. In the event of a claim, the Insured must report the damage to the Insurer via the designated reporting point within 3 (three) days of discovering the damage.

5.2. In the event of reports of theft or burglary, an official report to the police is required. The Insured must provide a copy of this report.

5.3. The Insurer reserves the right to request further information and/or additional evidence in order to assess the claim.

5.4. A claim for damages will only be honored if the damage occurred under circumstances that are explicitly covered by the coverage as described in Article 3 and do not fall under the exclusions of Article 4.

6. Premium Payment and Changes

6.1. The amount of the premium depends on the subscription form chosen and is charged periodically (monthly, quarterly or annually).

6.2. The Insurer reserves the right to revise the premium based on changed risks or market conditions. Changes in the premium will be communicated to the Insured in writing or digitally at least 4 (four) weeks before the start date of the new term.

6.3. If the Insured does not accept the amended premium, the insurance can be cancelled without further costs up to the end of the current term.

7. Duration of the Agreement and Termination

7.1. The insurance contract is entered into for an indefinite period with automatic renewal per subscription period, unless terminated in time by the Insured.

7.2. Termination must be made in writing or via the designated digital channel.

7.3. After cancellation, the insurance remains valid until the end of the current subscription period. After this period, the agreement will not be extended.

8. Liability and Precautions

8.1. The Insurer shall only be liable for the damage as described in Article 3, and reserves the right to reject claims for damages resulting from negligent or careless use by the Insured.

8.2. It is the responsibility of the Insured to handle the device with care at all times and to follow the manufacturer's instructions.

9. Disputes and Applicable Law

9.1. This agreement is exclusively governed by Dutch law.

9.2. Any disputes arising from or in connection with this insurance will initially be attempted to be resolved amicably. If an amicable solution is not possible, the disputes will be submitted to the competent court in the district where the Insurer is established.

10. Other Provisions

10.1. If one or more provisions of these general terms and conditions are declared null and void or unenforceable, the remaining provisions shall remain in full force.

10.2. Changes to these terms and conditions may be implemented by the Insurer, provided that the Insured is informed of this in writing or digitally at least 4 (four) weeks before the effective date of the change.

10.3. By taking out the insurance, the Insured declares that he/she has taken note of and agrees to these general terms and conditions.
